4.2.1    Introduction

The construction sector is a key sector of the economy in Turkey and covers a broad range of products. Ensuring that the materials used in construction are safe and high quality is, therefore, an essential objective of the Ministry of Public Works and Settlement. Up to now, the used system was very simple: a TSE mark was compulsory for all the construction products placed on the market. That mark was delivered by TSE on the basis of a Turkish standard (TS), around 400 TS were concerned. Inspectors and laboratories at provincial offices was the mechanism for market surveillance.

The Construction Products Directive (89/106/EEC) is a specific directive in the field of New

Approach. Its uses Interpretative Documents, which establish the link between the essential requirements and the mandates that the Commission gives to European standardisation bodies to establish harmonised standards and to the European Organisation for Technical Approvals to establish Guidelines for European Technical Approvals ( ETAG).

To date, at the European level, the situation is as follows:

Regarding legislation, there are 1 Directive for CPD (89/106) and 1 Directive on CE marking (93/68), 57 Decisions, 6 Interpretative Documents and 13 Guidance Papers. Concerning technical specifications, there are 364 Europeans Standards as harmonised and 29 ETAG. Moreover, 57 EN Eurocodes are expected.

For implementing the CPD directive in Turkey, MPWS has decided to set up a new system, namely CE-marking for the products which are subject to the harmonised standards and European technical approvals and a new mandatory national mark (G mark) for the others products. G mark is a safety mark delivered by a Conformity Assessment Body designated by the Ministry on a basis of Turkish standard. The national standards are determined by the Ministry, taking into account the decisions of the “Technical Committee of Construction Products” and shall be cited in Annex of a Communiqué. This national mark shall be mandatory after 01.01.2008.

4.2.2 Discussion

12 of the seminar participants joined the CPD workshop and the main topics raised during the discussion were as follows:

4.2.2.1    Notified Bodies

A Protocol has been signed between the Ministry of Public Works and Settlement and the Turkish accreditation body TÜRKAK on assessment and surveillance of notified bodies. Only two bodies has been notified, TSE for cement, aggregate materials, concrete additives and stone or brick elements and TCPA (Turkish Cement Producers Association )- Quality and Environment Board for cement .Two applicants, MEYER and Turkish Ready Mixed Concrete Association’s (THBB), have been evaluated and approved by TÜRKAK. The Ministry expects further NB applications. Procedures are not well known and too slow for a majority.

4.2.2.2    Transition period

The transition period for the implementation of the CPD was until 1st January 2007 and until then the old system was applicable. The market knows this. Due to the fact that there are very few notified bodies and that there is a transition period for application of G mark, (until 01.01.2008), question is raised for extending CPD transition period until 31st of December 2007.

4.2.2.3    G mark and European practices

A draft Communiqué on the national provisions concerning the Construction Products within the Scope of the Construction Products By-law (89/106/EEC) which do not have to be CE Marked has been sent to the Commission and EU members. No observations have been received. Corresponding systems are used in several EU countries.

4.2.2.4    Turkish standards

262 of 267 harmonised standards issued by the EU Commission have been transposed as Turkish standards. The rest 5 standards are expected to be transposed Turkish standards in May 2007 in line with the study programme of the TSE.

In the unregulated area, 279 standards exist, which have previously been enacted mandatory standards by the Ministry of Industry and Trade. These standards will be revised during the year 2007 for using in the context of the G mark, but around 40% are the transposition of European and international standards.

4.2.2.5    Eurocodes

For the time being there is no Eurocodes in national collection but it has been decided to transpose the EN Eurocodes as Turkish Standards and to prepare the National Annexes.

4.2.2.6    EuropeanTechnical Approval (ETA)

Still, there is not any European Technical Approval Organisation in Turkey in the field of construction materials. In order to solve this difficulty, a specific body, as an autonomous body in administrative and financial terms, has been planned to be founded under the Construction Research Association (YADDer). Within this context, through this way, the Research and Development activities in Turkey have been targeted to be developed especially in the construction sector.

4.2.2.7    Market surveillance

MPWS believes that the necessary mechanisms for market surveillance are in place. “Construction Materials Inspection Groups” have been formed comprising 371 inspectors at 81 provincial offices. These inspectors have been trained in market surveillance for the CPD directive.

4.2.2.8    Accreditation of laboratories

About 200 laboratories are engaged in testing, these laboratories are authorised by the Ministry. MPWS requires laboratories to meet the requirements of ISO/IEC 17025 but for the time being accreditation is not required. However, it requires contractual arrangements between certification bodies and the laboratories they use as subcontractors within the field of the CPD. Thus the certification bodies have to take responsibility for the work of the laboratories. This is particularly important when laboratories are not accredited.

4.2.2.9    Mutual recognition about G mark

The products, which have been manufactured according to national legislation consistent with the Treaty establishing the EU, shall be permitted to be placed on the market, in case they comply with the minimum requirements of the TS standards. With the reports and conformity attestations acquired from an EU member state, it is presumed that the minimum requirements are fulfilled. In case the products are imported from a third country, they may be placed on the market after bodies recognised by MPWS attest their conformity.

4.2.3    Conclusions

  • Regarding the implementation of CPD, all Turkish legislation has been adopted and promulgated: one law and 9 communiqués. The Communiqué on the National Provisions concerning the Construction Products within the Scope of the Construction Products By-law (89/106/EEC) which do not have to be CE Marked is expecting at the beginning of 2007.
  • The necessary Turkish standards for implementing CE marking and G mark are available. The market surveillance mechanism is ready and only the number of notified body is questionable. Therefore MPWS expects to increase the number of organizations currently authorised for G-marking as well as the number of notified bodies for CE-marking.
  • Concerning transition periods, market is waiting for the decision of MPWS but it is fully ready for the application of the new system.
